Booking conditions
AppleCottages.com Booking Terms & Conditions:
1. General
1.1
AppleCottages.com operates from the following address: Wooldown Farm, Marhamchurch, Bude, Cornwall, EX23 0HP.
1.2
AppleCottages.com accepts reservations on behalf of owners only on the conditions shown in the following booking conditions. Contracts accepted by AppleCottages.com shall be between the Person making the booking (Customer) and to the owner of the property for whom the booking is made (Owner). AppleCottages.com acts as Booking Agents for the owners of all the properties offered.
2. Booking
2.1
The person completing the Booking Form certifies that:
a) he/she is able to sign on behalf of all persons who will occupy the property for the period that has been booked and all occupying members are aware of the conditions, excluding infants.
b) they are over 18 years of age.
c) to take responsibility for the party occupying the property and to notify the Owner if they are not a member of that party.
2.2
A non-refundable deposit must be sent within 5 working days of booking or AppleCottages.com or the Owner may decide to re-let the holiday, in which case you will be notified by AppleCottages.com or the Owner in writing.
2.3
In the rare event of a double booking AppleCottages.com or the Owner will accept no further claim, and the contract between the Customer and the Owner will be terminated. If the holiday has been double booked AppleCottages.com and the Owner will endeavour to notify you as soon as possible and to find alternative accommodation.
2.4
AppleCottages.com or the Owner reserves the right to cancel any bookings already made or refuse any bookings made subject to refunding sums already paid without any further liability.
2.5
Failure to disclose full details of the number and sex of members of any party at the time of booking or upon arrival means that the Owner or AppleCottages.com at their discretion, cancel a booking prior to, upon arrival, or at any time during the stay of the party.
2.6
The Owner or AppleCottages.com reserve the right to refuse bookings by single sex groups, large parties and/or younger parties even if accompanied by an adult(s), at any time.
3. Amending a Booking
Once a booking has been accepted by AppleCottages.com and the Owner, the booking can only be changed to another property by treating the original booking as a cancellation (see section 8).
4. Deposit
4.1
If a booking is made 6 weeks or more before the Holiday start date, a 25% deposit of the full rent is payable.
4.2
If a booking is made within 6 weeks of the Holiday start date, then the full rent, and any additional charges must be paid.
4.3
In the event of AppleCottages.com or the Owner rejecting a booking request, the rent and any additional charges made by the Customer will be refunded by the Owner.
5. Final Payment
5.1
When the Booking Form has been sent along with payment and accepted by the Owner, the Customer is liable for payment of the balance of the holiday rental, along with any additional charges.
5.2
If payment has not been received at least 6 weeks prior to the Holiday start date, the Customer will lose their booking and the deposit will be forfeit.
5.3
AppleCottages.com or the Owner shall not be responsible for sending payment reminders, the agreed payment times will be stated on the Booking Form.
6. Extra Charges
Extras may be charged by some owners, which is indicated in the individual property descriptions. By booking the Customer agrees the owners right to charge extras either through AppleCottages.com as specified or directly.
7. Tax
Many Owners of properties listed on AppleCottages.com are not registered for VAT, in which case no tax is payable. Where VAT is payable the tax is included in the rental price.
8. Cancellations
8.1
In the event of a Customer wishing to cancel the Holiday, the property Owner must be notified in writing.
8.2
If the Customer decides to cancel their Booking at least 6 weeks before the holiday start date the Owner shall refund any monies paid less the deposit (deposit amount is 25% of full rental, if deposit amount is not stated).
8.3
In the result of a cancellation within 6 weeks of the holiday start date, the Owner has the right not to refund the Customer any sum of money. The Owner and AppleCotages.com will endeavour to re-let the property, if a re-let is successful the Customer will be refunded the total amount less the deposit (deposit amount is 25% of full rental, if deposit amount is not stated). The Customers refund will alter according to the duration re-let.
8.4
For the purpose of this condition, consecutive weeks at two or more properties are considered to be one Holiday.
9. Occupants and Pets
9.1
If the stated property occupancy shown on the website/brochure is exceeded or if persons not stated on the Booking Form occupy the property, the Owner of the property has the right to terminate the booking at any time, any monies paid by the Customer will be forfeit.
9.2
Pets are only accepted in some properties, as indicated on the website/brochure. The pet owner accepts liability for any damage they may do and agrees to the condition that pets will not be left unattended in the property. There may be an additional charge for pets in some properties. If a Customer takes a pet into the property without permission or without notifying the Owner in writing is in Breach of Contract and the Owner of the property has the right to terminate the booking and any monies paid by the Customer will be forfeit at any time.
10. Property Availability
10.1
Holidays normally commence from 4.00pm on the day of arrival “Holiday Start”, and end at 10.00 am on the day of departure “Holiday End”, unless otherwise agreed with the Owner or his/her key holder. The holiday dates are stated on the Booking Form and Confirmation to the Customer when they agree to book. Customers will be liable for any costs of whatsoever nature incurred because of an unauthorised extension.
10.2
In the event of the property becoming unavailable due to damage by fire or storm or for any reason outside the control of the Owner or AppleCottages.com for any reason the Owner is not able to comply with this agreement the Owner shall refund to the Customer the full amount of monies paid.
11. Property Details
All property details are given in good faith, all details should therefore be checked with AppleCottages.com before making a booking, or with the Owner after a booking has been made. AppleCottages.com reserves the right to change text, images and prices paper based or electronically at anytime.
12. Conditions of Stay
12.1
The Customer and occupants stated on the Booking Form agrees:
a) to allow AppleCottages.com and Owners access to the property in cases such as for essential maintenance.
b) not to exceed the stated property occupancy or allow other persons not stated on the booking form access to the property.
c) to take good care of the property including leaving it in a clean and tidy condition at the end of the Holiday. In the event the Owner is unhappy with the property condition on the Customers departure, the Owner has the right to charge the Customer a cleaning charge, which is payable at the time of departure.
d) not to remove items such as fixtures, fittings and appliances from the property.
e) not to smoke in a non-smoking property.
f) not to bring animals in a no pet property or without notifying and agreeing with the Owner.
g) to pay for any losses or damages to the property which have been caused by the Customer or member of their party this excludes reasonable wear and tear;
h) to pay for all electricity, gas, fuel and telephone charges incurred during the Holiday unless included in the rent.
i) not to engage in unacceptable behaviour that causes a disturbance or nuisance to other guests or occupants of adjoining premises.
12.2
The Owner reserves the right to terminate the Holiday immediately without being liable for any refund or compensation where the Customer and members of the party stated on the Booking Form engage in unacceptable behaviour that causes a disturbance or nuisance to other guests.
12.3
There may be further standard rules that are designed to ensure that the Owners comply with regulations relating to matters such as fire, health and safety. If you would like to check if there are further conditions please contact AppleCottages.com or the Owner.
13. Complaints
13.1
Any complaint must be taken up immediately in full with the Owner or key holder.
13.2
AppleCottages.com function is to server to the Owner as a Booking Agent. AppleCottages.com is not a party to the Contract between the Customer and the Owner and performs its functions entirely as a Booking Agent. In the event of the Customer contacting the Owner or key holder is still not satisfied they can contact AppleCottages.com to take reasonable steps as it is able to in an endeavour to put the matter right.
13.3
If AppleCottages.com or the Owners are denied the opportunity to investigate the complaint within a reasonable time or is denied the opportunity to put matters right during the Holiday then the guest will waive all rights.
14. Liability
Other than for death or personal injury caused by AppleCottages.com or the Owners negligence or misrepresentation, AppleCottages.com or the Owners total liability to the Customer is limited to the total cost of the Booking and to the fullest extent permitted by law all warranties are excluded and in no circumstances will AppleCottages.com or the Owner be responsible for any indirect or special damages.
15. Breach of Contract
In the event of a breach of any of these conditions by the Customer or any members of their party, the Owners or AppleCottages.com reserve the right to re-enter the property and end the Holiday and notify the Customer and their party to leave.
16. Validity Clause
In the event of a court finding that a condition in these Booking Conditions is illegal or void, the illegal or void provision will be severed from the remainder of the Booking Conditions, which will continue to be valid and have full force and effect.
17. Payment
17.1
Customers may pay by Cheque issued by UK bank made payable to the Owner direct in Pound Sterling – details included on the Booking Form.
17.2
Alternative payment can be made by Bank Transfer at Owners discretion, details available on request.
17.3
Overseas guests are responsible for paying all sending and receiving costs, all guests are reasonable for additional bank charges – such as administration fees or cheque representation fees.
